This article walks through the procedural stages of a disciplinary case under the CCS/Railway Discipline & Appeal (D&A) Rules — from the initial charge to the final appeal — as a quick-reference guide distinct from the exam-focused penalty classification covered in the Establishment & Financial Rules notes.

Stages of a Disciplinary Case (Major Penalty Route)

  1. Preliminary inquiry / fact-finding, if needed, to establish whether a formal charge is warranted.
  2. Framing and issue of a charge-sheet (memorandum of charge), stating the articles of charge and imputations of misconduct.
  3. Charged employee submits a written statement of defence within the specified time.
  4. If the defence is unsatisfactory or the charges are denied, an Inquiry Officer (and often a Presenting Officer for the department's case) is appointed to conduct a formal inquiry.
  5. Inquiry proceedings — examination of witnesses/documents, cross-examination, and submission of the Inquiry Officer's report with findings on each article of charge.
  6. Disciplinary Authority considers the Inquiry Officer's report, gives the employee an opportunity to represent against adverse findings, and then passes a final order imposing (or dropping) a penalty.
  7. Appeal — the employee may appeal the order to the specified Appellate Authority within the prescribed time limit; a further Review may be available in limited circumstances.
Minor Penalty Route — Simplified Procedure
  • For minor penalties, a full inquiry as above is not mandatory — the employee is given the substance of the imputation and an opportunity to make representation before an order is passed.
  • Even in the minor penalty route, a reasonable opportunity to explain must be given — this is a natural justice requirement, not optional procedure.

Exam Focus
A frequently tested distinction: major penalties require a formal inquiry with an Inquiry Officer, while minor penalties follow a simplified 'show cause' style procedure without one. Know which penalties fall in each category (see the Establishment & Financial Rules notes chapter for the penalty list).
